Terms of Service

When commissioning me, you must agree to these terms of service; otherwise, I will not accept your commission. Any statement can be revised if discussed with me, the artist, before the commission.

What I Will Draw

  • Anthro and Furry Characters

  • Animals and Mythical Creatures

  • Mild Gore (Some Blood, Cuts, Scars, Etc.)

  • Simplified Style

What I Will NOT Draw

  • NSFW (Content with Sexual, Fetishy, Crude, or Highly Suggestive Themes)

  • Heavy Gore (Intestines, Copious Blood, Torn Limbs, Etc.)

  • Hateful/Discriminatory Art

  • Complex Mech/Tech Items

General Terms

  • I only accept payment in USD through PayPal and Venmo

  • Any ill or rude behavior will not be tolerated, and your commission will be canceled if it occurs.

  • I will only accept communication through Instagram, Twitter, Discord, or E-mail.

  • If you have any questions for me, I will try to respond within 48 hours.

  • You may only commission art of characters you personally own, or have express permission from the owner of the character(s) to commission art of them.

  • I reserve the right to decline any commission that I do not feel comfortable making.


Usage

Commissions are currently for personal use only. As the commissioner you have the right to:

  • Use the art for profile pictures, banners, wallpapers, etc.

  • Share the art on your social media

  • Claim the rights to your character(s) but not the art itself

As the commissioner, if given my written permission, you may:

  • Edit or alter the commission, such as add filters, effects, etc. to the commission. (This does not give you leeway to say you made the art.)

  • Create explicitly personal merch (merch to be used only by you and not for profit), such as prints, keychains, etc., with the art.

  • Use the art in a video thumbnail.

  • Resell the art alongside the character(s) it depicts

  • Use the art in free, published material.

All the above uses must have proper credit to me, the artist, provided. For something to qualify as proper credit requires that I be mentioned by username and either how you found me online or the platform you used to commission me. For example: “Credit to @MochaCatCreations on Instagram”

As the artist, all rights to the art belong to me. With the art commissioned from me, you may NOT:

  • Claim you made the commission

  • Trace the commission

  • Use the art for personal profit

  • Use the art in AI of any kind, shape, or form. (See AI Policy for further details)

  • Use the art for NFTs or other cryptocurrencies

  • Use the art to promote hate speech

I may eventually share any commissions on my social media or use them as examples in my Art Gallery. If you do not want your commission shared publicly for any reason, please notify me beforehand.
If you want to commission me for work to be used commercially, contact me through the previously mentioned points of contact, and it can be discussed. If I accept such a commission, there will be a price increase and a separate Terms of Service will be written for the commission.


AI Policy

Use of AI in any kind, shape, or form is prohibited. By commissioning me, you agree to never use my art in AI. Not to train AI, not to ‘enhance’ my work, not to add or change it in any way. This includes the use of programs like ‘Grok,’ Chat GPT,’ Sora AI,’ ‘Character AI,’ and any other AI tools. Upon agreement to these Terms of Service and this policy, this applies to any past, present, and future commissions with me.

Turnaround Times

The time it takes for your commission to be finished will depend on multiple variables, including the complexity of your commission and, most importantly, personal life factors. These factors include the following:

  • School

  • Health

  • Work

  • Family Matters

  • Prior Commissions

I will always do my best to communicate with you to ensure the completed commission is one you are happy with. If, for any reason, something comes up that renders me incapable of working on the commission for any amount of time, I will inform you as soon as possible.

Payment

  • payment will only be accepted in USD through PayPal or Venmo

  • Once the sketch has been finalized and receives client approval, 50% of the commission cost must be down-paid before further progress will begin. The remaining 50% must be sent once the commission has been finished

  • As the client, you will not receive the unwatermarked version(s) of your commission until the other 50% payment has been sent


Cancellation/Refund Policy

  • As the client, you have no right to demand a refund. All payments are final, unless agreed upon otherwise in writing.

  • If the necessary down payment has not yet been sent, you have the right to cancel your commission.

  • If the lineart phase has been completed or the commission is further in the process, a full refund cannot be granted.

  • If, for any reason, I find myself unable to complete a commission, the client will be issued a full refund.

  • If a chargeback is filed against me, progress will be halted, and all rights to the commission will be retracted.

  • By filing a chargeback, clients may be personally blacklisted and forbidden from commissioning me in the future.

  • If deemed necessary, the client's account and proof of chargeback will be posted publicly with any sensitive information redacted. Should this decision be made, the client will be notified in advance of a post being made.

Process

Once we have discussed and confirmed your commission, I will provide you with an estimated start date for the sketch phase.
Throughout the process, I send all clients updates and share progress photos as I move through the different phases. These commission phases follow below:

  1. Sketch

  2. Lineart

  3. Color

  4. Background/Scene Work (if any)

  5. Shading

If you desire any major changes to be made to the drawing, the sketch phase is the ideal time to request them. I will always ask if there are any details you would like to see changed in the sketch before requesting the 50% down payment to be sent.
If you would like changes to be made during the later phases, or when the commission has been completed, I will gladly do so. However, any of the following changes may result in extra charge placed on the commission:

  1. Outfit change

  2. Outfit addition or subtraction

  3. Background/scene change

  4. Anything requiring me to completely redraw a large aspect of the commission (ie, wings added/changed, pose, etc.)

If I have made a mistake and/or misunderstood your commission request, you will not be charged for the corrections made.
Your satisfaction is a high priority. If at any point you are unhappy with my service, please notify me immediately and provide details of your concerns so I can address them promptly.
